We are often retained to handle particularly sensitive and complex investigations, crisis situations, and special assignments for companies and Boards of Directors. Our practice in this respect is unique; although our size enables us to take on matters where independence is essential, we have nonetheless been recognized by the 2023 Chambers USA Guide as one of the top firms for securities litigation (the only boutique recognized by Chambers in this category), and our white collar practice has been recognized both by Chambers and Law 360 as a “White Collar Group of the Year.” We offer our clients truly independent representation in corporate investigations paired with deep, nationally recognized expertise in shareholder and corporate matters.
In recent years, we have represented numerous committees of Boards of Directors of Fortune 100 companies in connection with investigations spanning a few months to those spanning multiple years. We currently represent the Special Litigation Committee of the Board of Directors of Xerox in investigating shareholder claims relating to purported insider trading by Carl Icahn. We also currently represent the Demand Review Committee of the Board of a leading global private equity firm with respect to shareholder derivative allegations.
We have also recently represented companies and individuals with respect to a variety of confidential internal investigations involving a wide range of subject matters, including governmental and regulatory investigations of institutions and members of their management; disputes arising out of mergers and acquisitions; securities and accounting matters and compliance issues; and oversight of debtor financial institutions during bankruptcy proceedings.
Our structure of highly experienced private practitioners and former federal prosecutors allows us to evaluate and address these critical situations rapidly and in a comprehensive and efficient manner. As highlighted in our rankings in the 2023 Chambers USA Guide, our partners have “broad capabilities” in “internal investigations,” “spearhead[] strategic decision making,” and are “trust[ed] during a very delicate and very sensitive time frame for the company.”
