Levine Lee files an amicus curiae brief on behalf of a group of economists in FuboTV Inc. v. The Walt Disney Company et al., in the U.S. Court of Appeals for the Second Circuit. The amici argue that the preliminary injunction entered by the U.S. District Court for the Southern District of New York—enjoining the launch of a joint venture that will offer a new live sports streaming service—is flawed as a matter of economic policy because it purports to protect a competitor at the expense of consumers, by depriving them of a lower cost alternative. The economists are Professor Aaron Hedlund of Purdue University; Professor R. Glenn Hubbard of Columbia University; Professor Jeff Prince of Indiana University; Professor Richard Schmalensee of the Massachusetts Institute of Technology; Professor Steven Tadelis of the University of California, Berkeley; and Professor David J. Teece of the University of California, Berkeley. Kenneth E. Lee and Steven W. Kessler submitted the brief.
